We Represent Advisors
We also represent members of the financial community, including financial advisors, who have been abused by the financial firms that employ them, including claims for fraudulent loan programs, wrongful termination, constructive discharge, and defamation on U-5 Forms.
Our counsel and representation is nationwide. If you have been mistreated by your former employer we can help you get justice. Our securities attorneys can advise you on the best course of action to take if you believe you have been wrongfully terminated. Our years of experience helps us successfully understand how to best represent your interests in front of government agencies like the SEC, FINRA, and other regulatory bodies. If you’re an advisor who’s worried that you were forced out we’re here for you.
Constructive Discharge and Wrongful Termination
Financial Advisors have a unique job. They sit at a crossroads between investors and their firm. A termination can have a ruinous impact on an advisor’s career. When there’s a contentious dispute over employment in this industry, false accusations can end up in both the public’s view and a potential new employer’s view. Scrutiny, difficulty in finding employment, and possible regulatory inquiry can sometimes be expected. Having legal counsel in these situations is critical. The LSC legal team is ready to file wrongful termination and defamation claims when required.
Form U-5 Defamation
What is a Form U-5? This is a form that a firm must file whenever a financial advisor departs the firm. If a financial advisor is let go of their position then a U-5 must be filed to the Central Registration Depository (CRD), by the financial firm, within 30 days of the termination event.
Financial Advisors need to know that changing a U-5 Form after it’s been filed is a tough job. It’s costly and time consuming. If you are thinking of leaving your current firm, starting your own, or if you believe you might be terminated, you need an attorney. Any mark on your U-5 can ruin your future.
